Petition Filed to Remove President Ruto and Deputy Gachagua

A coalition of over ten petitioners filed a petition in court on Friday seeking a referendum for the removal of President William Ruto and his Deputy, Rigathi Gachagua. The petitioners accuse the government of gross violations of the Constitution and gross incompetence. 

Within that period, they argue, the administration has violated all 14 chapters of the Constitution—from the sovereignty of the people, public finance, security, and public service within 23 months.

The petitioners argue that the Kenyan government has failed to deal in good faith with matters raised regarding the grievances of the Kenyan people, which has led to overwhelming civic unrest. 

In proving their case, they pointed out that the capacity of the Government to effectively deal with the challenges confronting Kenyans had been on a downward trajectory, and there is a perception of erosion of the legitimacy of the Presidency. 

Further, the petition condemns the inability of the government to uphold constitutional order in the face of crises, whether socioeconomic or political.

They are seeking an end to Ruto's tenure through petitioners in a group called the Kenya Border Traders (KBT), which wants a referendum. They claim that Parliament cannot be trusted anymore to impeach the head of state, saying that it is too comfortable with the executive.

The team has urged the CJ to constitute a five-judge bench to hear the case, arguing that this is something important to do in the future of the country. 

They add that no person stands above the law and the Constitution and also that all leaders must be accountable to the people. 

They argue that the current regime has brought an existential threat upon Kenya through ineptness and unwillingness to sort out what ails the country.
